The cancellation of any trip may occasionally be necessary for commercial reasons beyond our control, including when the minimum number of participants is not met for the trip to operate. The cost of your trip can be transferred to another departure date for no extra charge if we are forced to cancel your trip, or you may choose to opt for a full refund, including your deposit.

BY FORCE MAJEURE

Where a cancellation is caused by conditions or events beyond our control, such as natural disasters, pandemics (including COVID 19), border restrictions, terrorism or political instability, Experience Not Felt Possible will rebook you on another trip or offer you a future trip credit.The cancellation terms applicable on the date your booking was changed will apply if your booking is re-booked due to us cancelling your booking or to force majeure.Any credits and refunds issued for cancellations for any reason will be less any non-refundable expenses incurred by Experience Not Felt Possible. Experience Not Felt Possible is not liable for any costs incurred by you due to your booking, including but not limited to visas, vaccinations, medical expenses, clothing, equipment, testing, quarantine, travel insurance excess or non-refundable flights.

PASSPORT, VISAS AND TRAVEL VACCINATIONS

The traveller is responsible for ensuring their travel documents are valid and remain with them throughout the trip. The validity of a passport should extend at least six months beyond the date of return. Any and all passport, visa, vaccination, or other entry requirements must be verified by the rider and any adverse consequences resulting from incomplete or incorrect documentation are the sole responsibility of the rider. In providing information about visas, vaccinations, climate, clothing, luggage, and special equipment, we do so in good faith and as a courtesy, but we are not responsible for any errors or omissions. We cannot be held liable if you cannot travel, or incur any other loss, because you did not adhere to passport, visa, immigration requirements, or health requirements. Should you fail to comply with entry requirements or health requirements, you agree to reimburse Experience Not Felt Possible for any fines or other losses.

CONTRACT OF PARTICIPATION/WAIVER

I have carefully read the terms and conditions contained on these pages. For the right to participate in the experience, I accept the following:

COMMUNICATION OF UNDERSTANDING

While Experience Not Felt Possible has taken reasonable precautions to ensure my safety during participation in the Experience as well as the activities provided as a part of the Experience, I acknowledge that participation in the Experience involves some risks, dangers, and hazards. The risks covered by this agreement include, but are not limited to, fatigue, slips, falls, collisions, encounters with wild animals, changing weather conditions, altitude-related illnesses, acts of the public, or other experienced participants, accidents or illnesses in remote places without immediate evacuation or availability of medical supplies or facilities; and accidents occurring during travel associated with the Experience. It is possible for physical injuries, death, or damage to personal property to occur in the event that one encounters these risks, dangers, and hazards. It is recognized that it is impossible for Experience Not Felt Possible to identify every inherent risk, danger, or hazard. Nevertheless, I recognize and understand that I may encounter these, and other inherent risks, dangers, and hazards not specifically listed in this Agreement, at any time during the Experience.

ASSUMPTION OF RISK

The destinations for Experience Not Felt Possible are often in remote locations within developing countries. Many of our destinations do not have the same level of medical emergency services as developed countries provide. Often, the road transport can be uncomfortable and unreliable, and the hotel standards are not as high as those in Australia or other developed countries. In case of any failure in performance of the contract caused by you or a third party unrelated to the provision of the travel arrangements, Experience Not Felt Possible will not be liable.Safety is of the utmost importance to Experience Not Felt Possible. By taking part in the trip with Experience Not Felt Possible, you assume the risk of injury or death.By participating in the Experience, I accept and assume all inherent risks, dangers, and hazards, including those specifically listed above. While aware of the dangers involved, I voluntarily agree to participate in the Experience.  Therefore, I release and discharge Experience Not Felt Possible and its employees, subcontractors, service providers, and business partners from the responsibility for any bodily injury, death, property damage, or theft, or any of the consequences thereof, associated with my participation in this Experience. On behalf of myself and all those under the age of 18 within my party, I agree to this release of liability. I certify that I am the parent or legal guardian of any such minor.

COVID-19

I am aware, as a Traveller during the COVID-19 pandemic, that COVID-19 is a deadly and highly infectious disease that is spread primarily through personal contact.  I am also aware of the possibility that I may unknowingly transmit the disease to those in my vicinity if I do not take the necessary precautions.  Accordingly, I agree to adhere to all COVID-19 health and safety protocols and policies implemented by Experience Not Felt Possible during my travels, including any policies related to the COVID-19 Vaccine and Testing, as well as any protocols, policies, laws, rules, regulations and mandates that may be imposed by the local or national jurisdiction where I will travel. This is my acknowledgement and acceptance that travelling during the COVID-19 pandemic poses risks to my person and to third parties, and so I waive all rights to claim against Experience Not Felt Possible and release its employees, officers, directors, and agents from all claims that may arise under the COVID-19 pandemic in relation to my travel with Experience Not Felt Possible, including but not limited to my infection and transmission of Covid-19.  Should I provide Experience Not Felt Possible with false information regarding my vaccination or testing status, I waive any claim or defence I may otherwise have related to any harm or damages caused by, related to, or arising from such false information, and agree to indemnify and release Experience Not Felt Possible, its employees, officers, directors, and agents from any and all claims that may arise out of such false information.  Further, I waive any claim or defence I may otherwise have with regard to any harm or damage caused by, resulting from, or arising out of my failure to comply with the COVID-19 health and safety policies, protocols, laws, rules, or mandates issued by Experience Not Felt Possible, any local or national government, or any third party vendor associated with Experience Not Felt Possible, and do hereby release Experience Not Felt Possible, its employees, officers, directors, and agents from any liability arising therefrom.

RESPONSIBILITY FOR CONDUCT

By participating in the Experience, I accept responsibility for any negligent or reckless behaviour I may show. I understand that Experience Not Felt Possible accepts and assumes responsibility for its own negligent or reckless conduct. Additionally, I have been advised by Experience Not Felt Possible to purchase trip insurance.  In the event that I do not adhere to the guides’ instructions or act in a manner that could adversely affect the health, safety, or wellbeing of others, Experience Not Felt Possible has the right to cancel the trip at any time at my expense.

COMPETENCE TO PARTICIPATE

I have reviewed the trip itinerary/description and have requested and obtained any clarification necessary to determine whether I am capable of completing the trip physically and mentally, and I hereby confirm that I am able to meet those requirements and that I will inform Experience Not Felt Possible immediately if that situation should change either before or during the trip.  The company also reserves the right to cancel my trip at any time or exclude me from any activity if Experience Not Felt Possible, any of its guides, or any contractors responsible for any aspect of the trip or activity determine, at any time before or during the trip/activity, that I am likely to be unable to complete the trip/activity without undue risk to myself or others, at the company’s complete discretion.  Before participating in the Experience, Experience Not Felt Possible recommends I consult with a medical practitioner. I am responsible for determining whether the Experience is suitable for me.

EQUIPMENT

It is possible that Experience Not Felt Possible will provide me with equipment for use during the Experience. Although Experience Not Felt Possible checks the equipment before each tour, I am responsible for verifying the equipment’s condition upon receipt and alerting Experience Lead Guides of any changes in the equipment’s condition while I’m using it. Once Experience Not Felt Possible provides me with such equipment, I will have exclusive control over it. I confirm that I have been provided with a gear list and read and understood the contents. While on the trip and during any activities, I will follow the guides’ recommendations and carry or wear what they recommend.It is my responsibility to make sure that any and all equipment I bring with me on the Experience is in good working order and is suitable for the purpose for which they are intended. This includes, but is not limited to, a mountain bike, helmet, riding pads, gloves, sunglasses/goggles and any other items recommended on the gear list provided by Experience Not Felt Possible.

FIRST AID CONSENT

Should the need arise, I provide my permission for my Experience Not Felt Possible guide to administer First Aid to me and any minors accompanying me. In the event of any first aid procedure or medication administration in response to a medical or emergency situation involving myself or any minors travelling with me, I release, indemnify and hold Experience Not Felt Possible harmless from any and all actions or claims for damages whatsoever.

EXPERIENCE LEAD GUIDE AUTHORITY

The Experience Lead Guide, who represents Experience Not Felt Possible, represents the authority that you agree to abide by when you book online, over the phone, or in person. A tour’s conduct, itinerary and objectives are at the discretion of the Experience Lead Guide. You may be asked to leave the Experience If, in the opinion of the Experience Lead Guide, your behaviour or physical condition is putting the wellbeing of other people at risk, or if the Experience Lead Guide considers your general wellbeing to be at risk by continuing the tour, or if you are caught breaking the local law. You will have no right to a refund for unused services in this circumstance, and you will have to leave the accommodation. No further responsibility or liability will be accepted by us, including return travel arrangements. No refunds will be made and any fees or expenses incurred as a result of termination will not be reimbursed. While on one of our Experiences, you are responsible for any damage to your accommodation and any other items you damage or lose. You are responsible for these costs, which need to be paid locally. In the event that you are late for an activity or part of your travel arrangements, you may not be able to participate in a part of the itinerary. Should you miss a connection, you are responsible for catching up with the group and all costs of rejoining the group. It is your responsibility not to do anything or fail to do anything that may bring Experience Not Felt Possible into disrepute.

HEALTH & SAFETY

As part of my agreement, I agree to adhere to Experience Not Felt Possible health and safety measures, including, but not limited to, being honest and forthcoming with any symptoms that may or may not be related to Covid-19 or any other illness prior to or during your trip; practising social distancing as directed by my Experience Not Felt Possible guide; and keeping good respiratory and hand hygiene, including wearing a mask when necessary. The experience will also require me to disclose any preexisting medical conditions and/or physical, mental, or emotional impairments.

ERRORS AND OMISSIONS

Despite our best efforts to verify the accuracy of statements made in our trip documentation, including brochures, websites, and trip notes, we cannot be held liable for any error, omission, or unintentional misrepresentation that may occur.

PHOTOGRAPHS AND FILMING

Photographs and videos may be taken by Experience Not Felt Possible during the Experience. It is understood that Experience Not Felt Possible may use such photographs or videos for commercial purposes without payment or other consideration.

EXPERIENCE CHANGES

It is the goal of Experience Not Felt Possible to keep the Experience as advertised. Experience Not Felt Possible may, from time to time, be forced to modify, alter, or change the itinerary of the Experience; substitute accommodations; or omit or substitute specific advertised activities. It is at the sole discretion of Experience Not Felt Possible to make such decisions. Experience Not Felt Possible is not responsible or liable for any expenses or losses incurred by those decisions. A participant or guide may be restricted from participating in any activity associated with the Experience if Experience Not Felt Possible determines that such participation affects, impedes, or endangers their welfare or that of another participant or guide.  It is understood that Experience Not Felt Possible is not responsible for any losses or costs that may result from the exercise of this right.

AUSTRALIAN LAW 

This Agreement shall be governed, construed and enforced in accordance with the laws of Queensland, Australia.

PRIVACY

Experience Not Felt Possible does not store credit card or debit card information. By booking an experience through us, you consent to all the information you provide (excluding credit card information) being passed on to our partners, wherever they may be located. In addition, public authorities such as customs or immigration may also receive the information if requested by them, or as mandated by law. No information will be shared with anyone who isn’t involved in your travel arrangements. Any sensitive information, such as details regarding disabilities, dietary requirements, or religious requirements, will be treated confidentially. A member of our staff can discuss sensitive information in private and ensure that any requirements or health concerns are handled on a need-to-know basis. Our staff ensures the security of your information by taking the necessary precautions.
